These Terms of Service (“Terms”) are a legal agreement between you (“you”, “Customer”, or “Client”) and Blue Kai Fishing Charters (“Blue Kai Fishing Charters,” “we,” “us,” or “our”).

By booking, purchasing, or participating in any fishing charter, guided trip, or related service from Blue Kai Fishing Charters, you agree to these Terms.

If you do not agree, please do not use our services.


1. Our Services

Blue Kai Fishing Charters provides professional fishing charters, guided excursions, and related services for recreational and educational purposes.

Services may include private and group fishing trips, guided tours, sightseeing excursions, bait and tackle rental, equipment usage, photography, and other related activities.

We aim to deliver safe, enjoyable, and memorable experiences on the water while maintaining professionalism and compliance with all maritime regulations.


2. Booking & Scheduling

All bookings are subject to availability and confirmation.

Prices and trip durations are based on information available at the time of booking and may vary based on season, number of guests, trip type, or weather conditions.

We reserve the right to reschedule or modify trips due to weather, mechanical issues, or safety concerns.


3. Client Responsibilities

You agree to arrive on time at the designated departure location and comply with crew instructions at all times for your safety.

Please bring appropriate clothing, valid fishing licenses (if required), and any personal items you may need.

Guests must disclose any medical conditions or physical limitations that may affect participation before the trip begins.

Consumption of alcohol is permitted only in moderation; illegal substances are strictly prohibited.

Failure to comply with safety rules may result in trip cancellation without refund.


4. Payments & Billing

Payment is due at the time of booking unless otherwise stated in writing.

We accept major credit cards and approved online payment methods.

A deposit may be required to secure your reservation. Remaining balances must be paid before departure.

If a payment is declined, your booking may be canceled.

Late payments for corporate or group bookings may result in cancellation or additional fees.


5. Cancellations & Rescheduling

To avoid cancellation fees, please provide at least 72 hours’ notice if you need to cancel or reschedule.

Cancellations made less than 72 hours before departure may forfeit the deposit or be subject to a cancellation fee.

If Blue Kai Fishing Charters cancels due to unsafe weather or unforeseen circumstances, you may choose to reschedule or receive a full refund.

We are not responsible for travel costs or other expenses incurred due to cancellation.


6. Safety & Liability

Your safety is our top priority.

All trips are conducted by licensed captains and trained crew members.

Life jackets and safety equipment are provided and must be used as directed.

Fishing and boating involve inherent risks. By participating, you acknowledge and accept these risks, including potential injury, seasickness, or equipment malfunction.

Blue Kai Fishing Charters is not liable for injuries, property damage, or losses caused by weather, wildlife, or failure to follow safety instructions.


7. Weather & Unforeseen Delays

Trips are subject to weather conditions and may be delayed, shortened, or canceled at the captain’s discretion for safety reasons.

We will make every effort to notify you of changes and reschedule at a mutually convenient time.

If rescheduling is not possible, you will receive a full refund for canceled trips.


8. Property, Gear & Equipment

We provide high-quality fishing equipment, rods, reels, tackle, and bait.

Guests are responsible for any damage to or loss of provided equipment due to misuse or negligence.

Personal belongings are the responsibility of the guest. Blue Kai Fishing Charters is not liable for lost or damaged items.


9. Photos & Marketing

We may take photos or videos during charters for promotional purposes.

No personal information will be shared.

If you prefer not to be photographed or have images used in marketing, please inform us in writing at [email protected] before your trip.


10. Communication & Messaging

By providing your phone number or email, you agree to receive messages from Blue Kai Fishing Charters related to trip confirmations, weather updates, dock location details, billing, and limited promotional offers.

Message frequency varies.

Message and data rates may apply.

You may opt out of marketing texts at any time by replying STOP.

Reply HELP for help or contact [email protected] / (808) 849-9449.

Consent to receive text messages is not a condition of purchase.


11. Service Satisfaction & Refunds

We strive to provide every guest with a great fishing experience.

If you are dissatisfied with your trip, please notify us within 24 hours of completion so we can review your feedback.

Refunds are not guaranteed for issues related to weather, sea conditions, or lack of fish but may be considered on a case-by-case basis.


12. Limitation of Liability

To the fullest extent permitted by law, Blue Kai Fishing Charters’s total liability for any claim related to our services shall not exceed the total amount you paid for your trip.

We are not responsible for indirect, incidental, or consequential damages such as travel delays, loss of personal items, or cancellations due to unsafe weather.


13. Indemnification

You agree to indemnify and hold harmless Blue Kai Fishing Charters, its captains, employees, and subcontractors from any claims, losses, or damages arising from your actions, negligence, or failure to follow safety instructions during the charter.


14. SMS Terms & Conditions (A2P Compliance)

By providing your phone number and opting in, you consent to receive SMS and MMS messages from Blue Kai Fishing Charters regarding trip confirmations, weather updates, rescheduling notices, and promotional offers.

Message and data rates may apply.

You may opt out at any time by replying STOP, or request help by replying HELP.

We may use an automated system to send messages. Consent is not a condition of purchase.

15. Changes to These Terms

16. Governing Law

These Terms are governed by the laws of TX, USA.

Any disputes will be handled in the courts of TX or the nearest jurisdiction where Blue Kai Fishing Charters operates.
