These Terms of Service (“Terms”) are a legal agreement between you (“you,” “Customer,” or “Guest”) and Blue Kai Fishing Charters LLC (“Blue Kai Fishing Charters,” “we,” “us,” or “our”).

By booking, purchasing, or participating in any fishing charter, guided trip, or related service from Blue Kai Fishing Charters, you agree to these Terms.
If you do not agree, please do not use our services.


1 Our Services

Blue Kai Fishing Charters provides professional fishing charters, guided excursions, sightseeing tours, and related experiences.
Services may include private or shared charters, fishing instruction, tackle rental, bait, equipment use, and photography.
Our goal is to provide safe, enjoyable, and memorable time on the water while complying with all maritime and safety regulations.


2 Booking & Scheduling

Bookings are confirmed once payment or deposit is received.
Trip length and pricing depend on season, trip type, and number of guests.
We reserve the right to reschedule or modify trips because of weather, vessel maintenance, or safety concerns.


3 Guest Responsibilities

Arrive on time at the designated dock and follow crew instructions at all times.
Bring required fishing licenses, sunscreen, appropriate clothing, and any personal items you need.
Notify us of medical conditions or limitations before departure.
Alcohol may be consumed responsibly; illegal substances are prohibited.
Failure to follow safety instructions may result in early termination of the trip without refund.


4 Payments & Billing

Payment is due at booking unless otherwise agreed in writing.
We accept major credit cards and secure online payments.
Deposits are typically non-refundable once a trip is confirmed unless canceled by Blue Kai Fishing Charters for safety or weather reasons.
Unpaid balances must be cleared before departure.


5 Cancellations & Rescheduling

To avoid fees, cancel or reschedule at least 72 hours before departure.
Cancellations within 72 hours may forfeit the deposit.
If Blue Kai Fishing Charters cancels for unsafe weather or mechanical reasons, you may reschedule or receive a full refund.
We are not liable for travel or lodging costs related to cancellations.


6 Safety & Liability

Trips are led by licensed captains and qualified crew.
All safety gear—including life jackets—is provided and must be used as directed.
You acknowledge that boating and fishing involve inherent risks such as motion, weather, and wildlife.
Blue Kai Fishing Charters is not liable for injury, loss, or property damage resulting from natural conditions or failure to follow crew instructions.


7 Weather & Delays

Trips may be shortened, delayed, or canceled at the captain’s discretion due to weather or safety.
We will contact you promptly to reschedule or refund as appropriate.


8 Equipment & Personal Belongings

We supply rods, reels, tackle, and bait.
Guests are responsible for damage or loss caused by misuse.
Blue Kai Fishing Charters is not responsible for lost or damaged personal items.


9 Photos & Marketing

Photos or videos may be taken for quality control or marketing.
No personal information is shared.
If you prefer not to appear in photos, notify us in writing at [email protected] before your trip.


10 Communication & Messaging

By providing your phone number or email, you consent to receive messages from Blue Kai Fishing Charters regarding trip confirmations, weather updates, dock details, billing, and limited promotions.
Message frequency varies. Msg & data rates may apply.
Reply STOP to opt out or HELP for help. Consent is not a condition of purchase.


11 Satisfaction & Refunds

We want every trip to meet expectations.
If you are dissatisfied, contact us within 24 hours.
Refunds are not guaranteed for weather, sea conditions, or fish activity but may be considered case by case.


12 Limitation of Liability

To the fullest extent allowed by law, Blue Kai Fishing Charters’s total liability for any claim related to our services shall not exceed the total amount you paid for that trip.
We are not responsible for indirect or consequential damages such as lost property, delays, or cancellations due to unsafe weather.


13 Indemnification

You agree to indemnify and hold harmless Blue Kai Fishing Charters, its captains, crew, and agents from any claims or losses arising from your negligence or failure to follow safety instructions.


14 SMS Terms & Conditions (A2P Compliance)

By providing your phone number and opting in, you consent to receive SMS/MMS messages from Blue Kai Fishing Charters about trip confirmations, weather updates, rescheduling, and promotional offers.

These Terms are governed by the laws of TX, USA.
Any disputes will be handled in the courts of TX or the nearest jurisdiction where Blue Kai Fishing Charters operates.
